Application means the web application software provided by Us from which You can access Our Services.

Account means a unique account created for you to access our service or parts of our service.

Service refers to the product offers listed on Our Website and other platforms controlled by Us, including but not limited to appreciatory calls and celebratory calls.

Country refers to Nigeria.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the service, to provide the service on behalf of the Company, to perform services related to the service or to assist the Company in analyzing how the service is used.

Personal Data is any information that relates to an identified or identifiable individual.

Device means any device that can access the service such as a computer, a cell phone, smartphone, or a digital tablet.

Usage Data refers to data collected automatically, either generated by the use of the service or from the service infrastructure itself (for example, the duration of a page visit).

Usage Data

When you use the Happivibe Application, we collect information sent to us by your computer, mobile phone or other electronic access device. The automatically collected information includes but is not limited to data about the pages you access, computer IP address, device ID or unique identifier, device type, geo-location information, computer and connection information, mobile network information, statistics on page views, traffic to and from the sites, referral URL, ad data, standard web log data, still and moving images.

We use this information to verify the identity of our intended subscriber, provide features of our service, to improve, customize and secure our service. The information may be uploaded to the Company's servers and/or a Service Provider's server or be simply stored on your device or discarded after verification.

We may also use information provided by third parties like social media sites. Information about you provided by other sites is not controlled by Us and we are, therefore, not liable for how such third parties use your information.

PRIVACY RIGHTS

This Privacy Policy describes your privacy rights regarding our collection, use, storage, sharing and protection of your personal information. It applies to the Happivibe website and all databases, applications, services, tools and physical contact with Us, regardless of how You access or use them.

If you have created a username, identification code, password or any other piece of information as part of our access security measures, you must treat such information as confidential, and you must not disclose it to any third party.

We reserve the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of this privacy policy.

CONSENT

You accept this privacy policy when you give consent upon access to our platforms, or use our services, content, features, technologies or functions offered on our website, digital platforms or visit any of our offices for official or non-official purposes. This privacy policy governs the use of the Happvibe Services, unless otherwise agreed through a written contract. We may amend this privacy policy at any time by posting a revised version on our website, or placing such notice at conspicuous points at our office facilities. The revised version will be effective 7 days after publication.

USE OF YOUR PERSONAL DATA

The Company may use Personal Data for the following purposes:

To provide and maintain our service: including to monitor the usage of our service.

For the performance of a contract: the calling, texting or other acts as may be authorised by you to be done on your behalf for your loved one, represents the performance of Our Contract With You.

To contact you: To contact you by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products, or contracted services, including the security updates, when necessary or reasonable for their implementation.

To provide you with news, special offers and general information about other goods and services which we offer that are similar to those that you have already enquired about unless you have opted not to receive such information.

To manage your reqeusts: To attend and manage your requests to us.

To secure and protect your account : To protect your account.

To maintain appropriate business records: To comply with lawful requests by public authorities and to comply with applicable laws and regulations or as otherwise required by law.

We may share your personal information in the following sole situation:

With a Loved One: We may share your personal information with a Loved One you have authorised us to reach out to.

For Testimonials: We may use limited information obtained from you as Testimonials on our websites. You accept that your pictures and testimonials on all social media platforms about Happivibe can be used for limited promotional purposes by us. This does not include your trademark or copyrighted materials.

RETENTION OF YOUR PERSONAL DATA

The Company will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy, but such period shall not exceed 3 years. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Company will also retain usage data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our service, or we are legally obligated to retain this data for longer time periods.

TRANSFER OF YOUR PERSONAL DATA

Your information, including Personal Data, is processed at the Company's operating offices and in any other places where the parties involved in the processing are located. CUSTOMIZED ADVERTISING

Customized or Tailored Advertising: We may allow third-party service providers (ad networks and ad servers) and affiliate marketing third parties (such as e-commerce websites) to place cookies and/or other tracking technologies on your computer and mobile devices, in order to collect information about your use of the tool. They may use this information to optimize advert placements brought to you, and also, it may be used to relay to us the effects of marketing strategies which we may have used.

The Company as an entity does not have access to the use of tracking technologies from non-affiliated ad-based third parties, which may be placed on any device you use to access the tool. Such parties may offer you an opt-out option from the targeted adverts. Certain information which may be obtained by cookies through the tool may be derived from aggregated data or data you voluntarily submitted to us, which we may share with a service provider in an encrypted form. CHILDREN'S RIGHTS

The coverage of our services does not extend to minors under 18 years of age. The Platform is meant for persons 18 years or older. We will automatically delete any account and all the information within, once it detects attempts by any minor to sign into the Platform.

SECURITY

We take all required security measures (such as end-to-end encryptions, passwords, etc.) to ensure the safety of personal information provided by subscribers of this tool, to avoid unauthorized access. While assuring you that we have done everything necessary to protect your personal information from unauthorized access, you should also bear in mind that no security measure is 100% foolproof.

Hence, you are advised to protect your personal information, by securing your passwords and devices which you may use to access the tool. Make use of rare and strong passwords and keep them private, sign off on any shared device you may use to access the tool, not sharing or reusing an exposed password. We cannot and will not be held responsible for lost or stolen passwords, any unauthorized use of your personal information, nor for any unauthorized use of passwords on your account.

INFORMATION MANAGEMENT

Certain information which you may have provided on your profile, can be changed or deleted through the preferences section in your "Dashboard." Any incorrect information which you may have provided must be promptly updated or reviewed. As par request, we may close your account and delete your profile information from the tool.

Any information retained thereafter may be to comply with regulatory laws, assist with investigations of any subscriber, prevent fraudulent activities, settle disagreements, collect owed bills, enforce our rights or any other purpose otherwise approved by law. It is crucial to note that while an account may be removed, User Content provided by said account may not be changed or removed. By agreeing to this Policy, we will not be held responsible for retaining information related to your account, after deactivation.

EMAIL COMMUNICATION OPTIONS

You may opt-out from any email subscriptions we send to you, which dodo not directly relate to your account or services and quotations which you may have requested or received from us. Opt-out options will always be attached to such emails.

GOVERNING LAW

This privacy policy is made pursuant to the Nigeria Data Protection Regulation 2019 and other relevant Nigerian laws, regulations or international conventions applicable to Nigeria. Where any provision of this Policy is deemed inconsistent with a law, regulation or convention, such provision shall be subject to the overriding law, regulation or convention.
